INFORMATION ABOUT THE TIME AND CONDITIONS OF PRODUCT`S GUARANTEE

„Caffaro spółka z ograniczoną odpowiedzialnością Spółka komandytowa”

This document defines terms and conditions of realizing guarantee rights, in particular time of guarantee, rules of submitting the claims and realization of claims. „CAFFARO spółka z ograniczoną odpowiedzialnością spółka komandytowa” in Kazimierza Wielka (no. KRS 0000797510) introduces these terms and conditions of guarantee from the 1st of January 2015.

 

  1. Terms and conditions of guarantee –a set of responsibilities which apply to the Guarantor towards the Byuer due to the guarantee of „ CAFFARO spółka z ograniczoną odpowiedzialnością spółka komandytowa” products. Defect – damage, loss, or other feature that enables the correct use of the product, which results only from a manufacturing defect, inherent in the product. Product – made by „CAFFARO spółka z ograniczoną odpowiedzialnością spółka komandytowa” in Kazimierza Wielka. Automotive product that has clearly visible brand marking such as CAFFARO or ELSTERMANN or any other marking that allows its identification. Guarantor – manufacturer or other entity indicated by him, that realizes the obligations, resulting from the given guarantee towards the Buyer. Buyer– private person or entity that purchased Product.
  2. Guarantee described on the following terms and conditions covers every product made by „ CAFFARO spółka z ograniczoną odpowiedzialnością spółka komandytowa” in Kaziemierza Wielka (no. KRS 0000797510). If in doubt, confirmation that a product is produced by the "CAFFARO spółka z ograniczoną odpowiedzialnością spółka komandytowa" will be a visible mark of the Guarantor such as ELSTERMANN CAFFARO, that allows its identification. 
  3. Guarantee described on the following terms and conditions covers every product made by „ CAFFARO spółka z ograniczoną odpowiedzialnością spółka komandytowa” in Kaziemierza Wielka (no. KRS 0000797510). If in doubt, confirmation that a product is produced by the "CAFFARO spółka z ograniczoną odpowiedzialnością spółka komandytowa" will be a visible mark of the Guarantor such as ELSTERMANN CAFFARO, that allows its identification. 
  4. Guarantee lasts 24 months. Time of the guarantee starts on the day of product purchase.
  5. Buyer looses guarantee if: a) the complaint will be reported to the Guarantor after 30 days after detecting the defect, b) in case of defective product assembly or any other mechanical interference or product damage, c) if product is stored in conditions that cause its natural damage (moisture). Furthermore, guarantee rights expire after guarantee time, specified in Section 4.
  6. The obligation of the Buyer, who wants to use guarantee rights, is to make a proper claim. Claims should be reported: a) in writing, b) via email, on the address given by the Guarantor: biuro@caffaro.pl Claims reported in any other form will not be consider. Claim should have: description of the product in which the Defect was found, time and place of product purchase, description of the Defect, circumstances in which the Defect was found.
  7. Guarantor may ask the Buyer for sending: a) product with detected defect, b) photos of the product with detected defect, c) additional explanations Buyer has to cover the costs of sending defected product.
  8. The Guarantor has 10 days (counting from the date of reporting a Defect) to inform the Byuer whether the claim has been accepted or not. It can be done in two ways: in writing or via email. If the claim is accepted, Guarantor indicates the way of removing the Defect either it is the replacement of the defected product for the new one or the repair. If replacement or repair are not possible, Guarantor will refund the money paid for the Product (on the basis of the proof of purchase). Replacement, repair or refund comes after 10 working days after claim acceptance. If the Guarantor asks the Byuer for additional information (according to section 7), time of claim consideration, replacement or repair of the defected product or money refund, extends accordingly. If claim is not accepted, Guarantor has to justify its decision.
  9. In case of product replacement, Guarantor has the right to indicate the Buyer a place in which he will be able to pick up the new product (shop/wholesale). In other cases, Guarantor has to cover the costs of sending a new part, free of defects to the Buyer.
  10. The above Terms and Conditions of Guarantee do not exclude the right of the Buyer that result from the warranty.
